The effective dates of claimed subject matter in transition applications can affect which prior art law—pre-AIA law or post-AIA together with pre-AIA 35 U.S.C. 102(g)—governs an application. An evaluation of the patentability of claims in a transition application or patent can produce different results depending on which of the laws applies.
