Trademark-Related Solicitation Scams

Have you received an official-looking letter or invoice from the Patent & Trademark Agency located in New York City?  How about one from the Trademark Compliance Office in Arlington, VA?  These are two of the several companies that offer what they call “trademark-related services.” These companies use terms that resemble an official agency name including one or more of the terms “United States,” “U.S.,” “Trademark,” “Patent,” “Registration,” “Office,” or “Agency.”  Many of these solicitations will even contain accurate information about your trademark registration and cite correct information, such as the requirement that a registration must be renewed every 10 years. One common theme with all of these solicitations is they are seeking fees for services that have no legal significance to your trademark registration.

Watch out for these trademark scams

Shortly after filing a trademark application, with the United States Patent and Trademark Office (USPTO) or with another non-US, government trademark agency, a growing number of our clients inevitably receive one or more official-looking letters or invoices seeking payment related to the trademark registration. You may have received one of these notices in the mail or via email yourself—a solicitation, formatted to look like an official government document, that lists data about your trademark application and even an image of your trademark (all of which is publicly available information). Many of these companies use terms that resemble an official agency name including one or more of the terms “United States,” “U.S.,” “Trademark,” “Patent,” “Registration,” “Office,” or “Agency.” The truth is, these solicitations have absolutely no legal or other significance to your trademark registration.

President Signs Defend Trade Secrets Act Into Law

Congress just gave trade secret owners a new way to defend their secret sauce. The Defend Trade Secrets Act (DTSA) was signed into law on May 11. An extension of the federal Economic Espionage Act, DTSA allows trade secret owners to bring a civil action in U.S. district court seeking relief for trade secret theft, also known as misappropriation.
